  • The generative AI process is automated and probabilistic. We do not guarantee that any generated output will be unique, error-free, or suitable for your specific intended purpose.

  • Due to the nature of the technology, similar input parameters may yield similar outputs for different users.

4. Intellectual Property Rights

  • Your Input: You retain all ownership rights to any text prompts, images, or other data you upload or submit to the Services ("Input"). You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your Input solely for the purpose of providing the Services to you.

  • AI-Generated Output: Subject to your full compliance with these Terms and payment of all applicable fees, we hereby assign to you all of our right, title, and interest in and to the design assets generated by the Services based on your Input ("Output"). You are solely responsible for ensuring that your use of any Output complies with applicable laws and does not infringe the rights of any third party.

  • Our IP: The Site, Services, and their entire underlying technology (including software, algorithms, UI, and designs, excluding your Input and Output) are owned by So Next Year Ltd and are protected by copyright, trademark, and other intellectual property laws.

5. Acceptable Use You agree not to use the Services:

  • To generate content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

  • To infringe upon the intellectual property rights or other proprietary rights of any party.

  • To reverse engineer, decompile, or disassemble any aspect of the Services.

  • To exceed any usage limits or quotas applied to your subscription tier.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
